Welcome to the YuIA website! Before taking advantage of everything our platform offers, it is important that you carefully read and agree to these Terms of Use. These terms govern the use of our website https://yuia.com.br and any digital services offered by YuIA. By using our website and services, you agree to all the conditions below. If you do not agree with any part of these Terms, we recommend that you do not use our services.

1. Acceptance of Terms​

About the platform: YuIA is an online platform that aggregates the best Artificial Intelligence (AI) tools on the market in one place, allowing users to access them through a single subscription. The platform is owned and operated by the company YuIA, registered in Brazil under CNPJ No. 48.005.030/0001-17. For the purposes of these Terms, the company and the platform will be referred to simply as "YuIA."

By accessing or using the YuIA platform, you declare that you have read and agree to these Terms of Use, as well as our Privacy Policy. Acceptance occurs at the time of first use or registration on the website. If you do not agree with the Terms, you should not use the platform.

We are continuously improving our services and may update these Terms periodically to reflect improvements or legal changes. When significant changes are made, we will publish the updated version on the website and may send a notice through the contact channels you have provided (for example, email). Continued use of the platform after the publication of a new version will constitute acceptance of the revised Terms. If you do not agree with the changes to the Terms, you should discontinue use of YuIA.

2. Registration and Access​

To access certain features of YuIA, it may be necessary to create an account. You must be at least 18 years of age to use the platform. By registering, you agree to provide true, complete, and up-to-date information, including a valid email address and any other data requested. The account is individual, personal, and non-transferable – sharing your account or access credentials with third parties is not permitted.

You are responsible for maintaining the confidentiality of your login and password, as well as for all activities that occur under your account. Notify us immediately at suporte@yuia.com.br in the event of unauthorized use of your account or any security breach. YuIA is not responsible for losses or damages resulting from failure to comply with this clause.

Personal and exclusive use: Access to YuIA services is solely for the personal use of the account holder. It is prohibited to sell, rent, lend, or otherwise transfer your access to any other person. YuIA reserves the right to immediately suspend or cancel the account in the event of improper sharing or any violation of this rule, without the right to a refund.

3. Plans, Subscriptions, and Credits​

YuIA offers different subscription plans, including a free plan and paid plans, available in monthly or annual subscription options (with a discount on the annual subscription). By subscribing to a paid plan, you will have access to features and AI models as described in the plan offering at the time of purchase.

Credit system: Our system operates with usage credits. Depending on the plan chosen, each user may receive credits in different formats:

  • Daily credits: Some plans provide a batch of credits that is renewed daily. For example, accounts on the free plan may receive a limited number of credits per day, while certain paid plans receive a greater amount of credits daily. Daily credits are automatically renewed each day, but are not cumulative – meaning unused credits expire and are reset the following day.

  • Monthly credits: Other plans may offer monthly credits. In these cases, the user receives a batch of credits that can be used throughout the entire month. Monthly credits are automatically renewed each month, but are also not cumulative – meaning unused credits expire and are reset at the beginning of the next month.

The amount of credits and the renewal model (daily or monthly) depend on the plan chosen as described in the offering at the time of purchase.

Credit consumption: Virtually any action within YuIA consumes credits. This includes, but is not limited to:

  • Sending messages or questions to AI models (chatting with artificial intelligences).
  • Generating or editing images using AI.
  • Using the voice feature (speaking with AI by voice).
  • Uploading files (such as PDFs, Word, Excel) for analysis, summarization, or translation.
  • Sending images for identification or content analysis.
  • Performing web searches through the integrated AI.

Each type of action or AI model may debit a different amount of credits, according to its computational cost and the fees charged by our partners' APIs (for example, OpenAI, Google, Anthropic models, among others). YuIA may periodically adjust the credit cost of each feature, as well as the amount of credits provided, in accordance with cost changes and service improvements. We will keep our users informed about any significant changes in this regard.

Credits serve only to measure platform usage and have no monetary value. They are non-refundable and cannot be exchanged for money or transferred between accounts. The efficient use of credits is the user's responsibility; once available credits are exhausted, it will be necessary to wait for renewal (daily or monthly, depending on the plan) or upgrade your plan to continue using the services.

Payment and renewal: When opting for a paid plan, you must provide valid payment information (for example, credit card details or use available payment methods such as PIX or boleto through our partners). Subscriptions are charged on a recurring basis, according to the chosen period (monthly or annual), through automatic renewal at the end of each cycle. You authorize YuIA (or designated payment processors, such as Stripe or Mercado Pago) to automatically charge the renewal amount, unless you cancel the subscription before the next charge. Promotions or discounts eventually offered for the first period may not apply to subsequent renewals, unless explicitly indicated.

If you do not wish to continue with the paid subscription, you may cancel it at any time through your account or by contacting support. Cancellation prevents future charges, but you will continue to be able to use the benefits of the contracted plan until the end of the already-paid period.

Refund and Cancellation Policy: YuIA follows the provisions of the Consumer Protection Code regarding the right of withdrawal in online purchases and contracts (Article 49 of Law No. 8,078/1990). If you subscribe to our service and are not satisfied, you may request a refund within 7 (seven) days from the effective date of the subscription, provided that the limited-use condition described below is met.

Conditions for refund: To be entitled to a refund of the amount paid, you must have consumed up to 10% of the total credits provided by the contracted subscription. The right of withdrawal constitutes a reflection period for evaluating the service, not a free trial. Since YuIA immediately provides full access to the platform and the credits consumed represent real costs paid to AI providers (which are not reversible or refundable), the 10% limit ensures a balance between the consumer's right and the viability of the service. For example, on a monthly plan with 100,000 credits, the refund will only be granted if you have used up to 10,000 credits. If you consumed more than 10%, the refund will not be applicable, but you may cancel the automatic renewal.

To exercise this right, simply access your YuIA account within the 7-day period. In the "Subscription" section, you will find the option to request a refund. We will automatically verify credit consumption and, if eligible, the refund will be processed using the same original payment method.

After the initial 7 days of the first subscription, the refund will no longer be available. However, you may cancel the automatic renewal of your subscription at any time by accessing your YuIA account and using the cancellation option in the "Subscription" section, thus avoiding future charges at the end of the current cycle. In all cases, we strive to treat our users with transparency and respect, so if there is any dissatisfaction, we encourage you to contact us so we can find the best solution.

Important: This refund policy applies exclusively to the first subscription of the plan. Automatic subscription renewals are not subject to the right of withdrawal, but you may cancel the automatic renewal at any time to avoid future charges. After the 7 days from the initial purchase have elapsed, the right to a refund is no longer available, leaving only the option of canceling the renewal.

In the event of delay or failure to pay for a renewal, we may suspend access to your paid plan features until the situation is resolved.

4. Rules of Conduct and Acceptable Use​

By using YuIA, you agree to follow standards of conduct that ensure a safe and respectful environment for everyone. You agree not to engage in any of the following prohibited activities:

  • Illegal or harmful use: Do not use the platform for unlawful purposes, to violate any applicable law or regulation, or to promote fraudulent, violent, discriminatory, defamatory activities or activities that infringe upon the rights of third parties.
  • Violation of third-party rights: Do not send, store, distribute, or generate content that violates the intellectual property rights of third parties (such as copyrights, patents, trademarks, or trade secrets) or personality rights (honor, privacy, image of third parties). You must possess all necessary rights and permissions over any content or data you submit to YuIA.
  • Inappropriate content: Do not use the services to produce or disseminate illegal, offensive, threatening, harassing, slanderous, obscene, pornographic, pedophilic content, content inciting violence, hate speech, or any material that is inappropriate or contrary to morality and good customs.
  • Reverse engineering and system misuse: Do not attempt to circumvent, avoid, or violate any security measures of the platform. This includes not attempting to gain unauthorized access to YuIA systems or those of our providers, not exploiting vulnerabilities, not using unauthorized automation tools (bots, scraping scripts, etc.) for data extraction or service overload, and not engaging in reverse engineering, decompilation, or any form of interference with the code, AI models, or APIs provided.
  • Abuse of limits and multi-accounts: Do not deliberately circumvent imposed usage limits (such as daily credit limits or messages per minute). It is prohibited to create multiple accounts to obtain undue advantages (for example, multiplying available credits) or any attempt to manipulate the credit and subscription system to your benefit.
  • Unauthorized commercial use: Do not resell, rent, or commercially exploit YuIA services without express authorization. It is also prohibited to use results generated by the platform as if they were produced by a human to deceive third parties, or to use YuIA in a way that unfairly competes with the platform itself (for example, using results to develop or train competing AI models).
  • Compliance with AI model policies: YuIA integrates artificial intelligence models from various partners, each of which has its own use and content policies. You agree to use the artificial intelligences in accordance with these policies. Do not attempt to generate, through our platform, content that violates the guidelines of the integrated models (such as material prohibited by OpenAI, Google API policies, etc.). If such attempts are detected, we may block the generation of such content and warn or suspend the offending user.

You understand that you are solely responsible for the content of your interactions on the platform (whether questions, uploaded files, images, or generated results). YuIA does not actively monitor conversation content but reserves the right to remove or block any user-generated content and to terminate the access of users who violate these Terms or any applicable laws. Any improper or abusive use of the platform may result in suspension or termination of your account, at YuIA's sole discretion, without prejudice to any applicable legal measures and without the right to a refund in the event of penalties applied for violation of these Terms.

5. Third-Party Services and AI Partners​

To provide its services, YuIA relies on various external partners and service providers. This includes both the companies that provide the integrated artificial intelligences and infrastructure, payment, and other services. It is important to be aware of how these partnerships work:

  • Artificial Intelligence Partners: The YuIA platform intermediates access to advanced AI models provided by third parties, such as: OpenAI (ChatGPT), Google (Gemini), Anthropic (Claude), xAI (Grok), among others that may be added to our ecosystem. By using YuIA's AI features, you acknowledge and agree that your inputs (questions, commands, data sent) will be shared with the corresponding AI provider to enable the generation of responses or results. Each AI partner may have its own Terms of Use and Privacy Policies; by using their models through YuIA, you are also subject to these rules. These partners are recognized companies committed to data security and confidentiality; we recommend that users consult each partner's policies to understand how their data may be processed by them.

  • Infrastructure and Payment Services: YuIA uses trusted third-party providers to ensure the operation of the platform and transactions. For example, Cloudflare is used for security and performance (content delivery network and attack protection), Microsoft Azure for cloud hosting and processing, Stripe and Mercado Pago for processing subscription payments, Google AdSense for serving ads (in the case of free plan users, if there is advertising), and Brevo (Sendinblue) for sending user communication emails. By using YuIA, you agree that certain necessary data (such as browser information, payment data, email, etc.) may be transmitted and processed by these third parties, as necessary for the provision of the service. YuIA seeks to contract only with companies that adopt rigorous security and privacy standards. However, such third parties have their own terms and policies and operate independently; YuIA is not responsible for acts or omissions of these providers, to the extent permitted by law.

YuIA does not access, read, or store the specific content of your conversations beyond what is necessary for the operation of the service (for example, to display your recent history during an active session or as described in our Privacy Policy). Your interactions are processed automatically by the partner AI models, not by human reviewers at YuIA. The data we may store (such as conversation texts, files, or images sent) is used solely to enable the features offered to you and for internal system improvements, always in accordance with our Privacy Policy. We do not share the content of your interactions with any third party other than the partners and services listed above, which are indispensable for the operation of the platform.

6. Intellectual Property​

Intellectual property rights related to the website, brand, and YuIA services belong to YuIA or are licensed to YuIA. This includes all content and materials made available by the platform, such as texts, images, logos, graphics, design, source code, features, software, databases, and other content created by YuIA. These materials are protected by Brazilian legislation and international treaties on copyright, industrial property, and other applicable regulations.

By using the website, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and use YuIA's services and content solely for personal and non-commercial purposes, as provided in these Terms. It is not permitted to: copy, reproduce, distribute, transmit, display, execute, publish, modify, create derivative works, or commercially exploit any content from the platform without prior written authorization from YuIA. Any unauthorized use may result in civil and criminal liability, under the terms of Law No. 9,610/98 (Copyright Law) and other intellectual property protection laws.

All trademarks, trade names, logos, and distinctive elements displayed on YuIA are owned by the company or used under license. These Terms do not grant you any license or right to use such trademarks and distinctive signs, except as necessary to identify and use the services, always in compliance with any YuIA brand guidelines.

User content and rights over results: By using YuIA, you may provide your own content, such as questions, commands, texts, files, and other data ("Contributions"), and you will receive content generated by the artificial intelligences in response to your requests ("Results"). You retain all intellectual property rights that you may hold over the Contributions you submit to the platform. Regarding the Results generated by the AIs from your Contributions, to the extent permitted by applicable law, YuIA does not claim ownership over these Results – they are made available to you and may be freely used by you, under your responsibility, while respecting any third-party rights that may be embedded in the generated content.

Be aware that, due to the nature of artificial intelligences, Results may not be exclusive and other users may receive similar responses. If a Result provided by YuIA contains excerpts from works or third-party information (for example, excerpts from publicly available texts), such excerpts may be protected by copyright or other rights. Verifying the appropriate use of Results is your responsibility. YuIA does not guarantee that content generated by AIs is free from potential infringement of third-party intellectual property rights. Therefore, use Results with discernment and, if you plan to share or use them commercially, evaluate the need to obtain authorizations or licenses from original rights holders, where applicable.

By submitting any Contribution on the platform, you grant us a non-exclusive, worldwide, royalty-free, and sublicensable license to use, store, process, and transmit such content for the purpose of operating and improving YuIA services. This license allows, for example, us to send your question to the appropriate AI model and return a response, as well as to conduct internal analyses to improve the user experience. We will not use your Contributions publicly or outside the context of service provision without your explicit consent; the use is strictly linked to the internal operation of the platform, in accordance with our Privacy Policy.

YuIA respects the intellectual property rights of third parties and expects users to do the same. Use of the platform must comply with current copyright legislation (Law 9,610/98) and other applicable regulations. We remain attentive to regulatory developments regarding AI-generated content and, should new laws or guidelines come into force, these Terms may be adjusted to ensure legal compliance.

7. Disclaimer of Warranties​

YuIA services are provided "as is," that is, as available and without warranties of any kind, whether express or implied. To the maximum extent permitted by law, YuIA and its suppliers and partners disclaim all warranties regarding the service. In particular:

  • Availability and errors: We do not guarantee that the service will operate uninterruptedly, securely, or free of errors. There may be temporary unavailability, failures, delays, or defects that will be corrected as soon as possible, but YuIA does not guarantee the total absence of bugs or interruptions.
  • Results and accuracy: YuIA does not guarantee that the Results provided by the artificial intelligences will be correct, accurate, complete, current, or suitable for a specific purpose. Responses and generated content are produced automatically based on probabilistic models and may occasionally contain errors, inaccuracies, or inappropriate content.
  • Use at your own risk: You acknowledge that you use YuIA at your own risk. You should independently evaluate the accuracy and usefulness of the information provided before making any decision based on it. Results should not be your sole source of information and do not replace professional advice (for example, in medical, legal, financial areas, etc.). Always verify important information from reliable sources and, where appropriate, consult qualified professionals.
  • Absence of implied warranties: To the extent permitted by law, we do not offer implied warranties of merchantability, fitness for a particular purpose, non-infringement, or any other warranties not expressly mentioned in these Terms.

No advice or information, whether oral or written, obtained by you from YuIA will create any warranty not expressly stated in these Terms of Use.

8. Limitation of Liability​

To the extent permitted by law, YuIA and its affiliates, partners, employees, or associates will not be liable for any indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use our service, including, without limitation: loss of profits, loss of revenue, loss of data, business interruption, reputational damage, or third-party claims. This limitation applies even if we have been advised of the possibility of such damages.

Additionally, YuIA is not responsible for:

  • AI content: Any content generated by artificial intelligences in response to your requests. The platform acts as a technological intermediary and does not endorse or pre-verify each Result provided by third-party models.
  • Third-party acts: Failures, omissions, or damages caused by integrated third-party services, including infrastructure providers (such as internet, hosting, cloud services), payment gateways, email services, or the AI providers themselves. Each of these third parties is responsible for their performance to you, under the terms of the respective agreements you establish with them (even if through these Terms of Use).
  • User misuse: Consequences arising from the use of the platform in a manner inconsistent with these Terms or in violation of the law. You are exclusively responsible for your use of YuIA and for any content you provide or results you use, as well as for any damages caused to yourself or third parties.
  • Force majeure: Events beyond YuIA's reasonable control, such as natural disasters, power failures, internet disruptions, sophisticated cyber attacks, government actions, or other force majeure events, under the terms of Article 393 of the Brazilian Civil Code.

In any event, YuIA's total aggregate liability to you, for all damages, losses, and causes of action, shall not exceed the amount you may have paid to YuIA for the use of services in the 12 (twelve) months preceding the event giving rise to the claim. If you use the free service, or there are no related payments, YuIA's total liability shall be limited to R$ 0 (zero reais).

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, the above exclusions and limitations shall be interpreted to apply to the maximum extent possible under applicable law, but some provisions may not apply to you. Nothing in these Terms affects any inalienable legal rights that may be assured to you as a consumer.

You agree that, in the event you allege any right or take any action against YuIA, such action shall be limited to the resolution mechanisms provided in these Terms and must be initiated within 1 (one) year from the triggering event, subject to forfeiture, unless mandatory applicable law provides a different period.

9. Termination and Account Suspension​

You may decide to stop using YuIA at any time, simply by ceasing your activities on the platform and, if applicable, canceling your active subscription as described in Section 3.

On the other hand, YuIA reserves the right to suspend or terminate your access to the service (or any part of it), as well as remove content associated with your account, in the following circumstances:

  • If you violate these Terms of Use or other linked policies (such as the Privacy Policy or specific rules of conduct).
  • If necessary to comply with legal obligations or a judicial/administrative order.
  • If the use of your account indicates a security risk, fraud, or potential harm to YuIA systems, partners, or other users.
  • If you use the platform in a way that may expose us to undue liabilities, abuse situations, or any illegal activity.
  • If the use of fraudulent or artificial means to gain advantage is detected (for example, creating multiple accounts to circumvent limits).
  • In the event of prolonged inactivity: free accounts that go without any access for a period exceeding 12 months may be terminated due to inactivity. For paid accounts, we may opt not to renew at the end of the contracted cycle if they have been inactive for a similar period, after notifying the user.

In cases of account suspension or termination due to violation of these Terms, no refund shall be due, and we may choose not to readmit the offending user to our services. YuIA also reserves the right to take appropriate legal measures in the event of misuse causing damage to the platform or third parties.

If you believe your account was suspended or terminated by mistake, or improperly, please contact our support so we can review the situation. The decision regarding account reactivation will be at YuIA's sole discretion, after evaluation of the case.

If YuIA itself decides to permanently discontinue the platform or a specific service (for commercial, technical, or legal reasons), we will make reasonable efforts to notify you in advance. In the case of paid plan subscribers with remaining pre-paid subscription time, YuIA may, at its discretion, offer a proportional refund for the unused service time due to the discontinuation.

10. Changes to Terms​

YuIA may modify, alter, or update these Terms of Use periodically. Whenever a significant update is made, we will publish the new version on the website with an indication of the last update date at the top of the document. We may also send a notice of change to the email address associated with your account or through notifications on the platform itself.

We recommend that you review these Terms from time to time to stay informed about our conditions of use. If you continue to use the YuIA website or services after the updated Terms take effect, this will constitute agreement with the revisions. If you do not agree with any change made, you should discontinue use of the platform and, if you are a subscriber, you may cancel your subscription before the next renewal to terminate the contractual relationship under the Terms in effect at the time of purchase.

11. Applicable Law and Jurisdiction​

These Terms of Use are governed by the laws of the Federative Republic of Brazil, especially consumer protection regulations and other legislation applicable to electronic commerce and digital services.

To resolve any doubts, questions, or disputes arising from the interpretation or fulfillment of these Terms of Use, the parties elect the courts of Belo Horizonte, State of Minas Gerais, Brazil, as the competent forum to resolve them, waiving any other forum, however privileged it may be.

If you use YuIA as a final consumer (for non-professional use), you may opt to submit any dispute to the courts of your domicile, under the terms of Article 101, item I, of the Consumer Protection Code, if this differs from the forum elected herein.

12. Final Provisions and Validity​

Any tolerance on the part of YuIA in requiring strict compliance with any condition of these Terms, or the non-application of any penalties, shall not constitute a waiver of rights, novation, or contractual modification, nor shall it prevent the company from demanding compliance with the same obligation in the future.

If any clause or provision of these Terms is deemed illegal, invalid, or unenforceable, in whole or in part, by a court or competent authority, such provision shall be applied to the maximum extent permitted, and the part declared invalid shall be deemed severable from the remainder of the contract, without affecting the validity and enforceability of the remaining conditions.

These Terms of Use, together with YuIA's Privacy Policy and any other terms or policies mentioned in this document, constitute the entire agreement between you and YuIA regarding the use of the platform and its services, superseding any prior understandings or agreements, written or verbal, that may conflict with what is set forth herein.
